1. AGREEMENT OVERVIEW These Terms and Conditions constitute a binding agreement between Gabby Aguirre Photography (hereinafter referred to as “Photographer”) and the booking party (hereinafter referred to as “Client”). By booking a session or event, the Client agrees to these terms in their entirety.
2. RETAINER AND PAYMENT
Non-Refundable Retainer: A non-refundable retainer of [X]% of the total package price is required to secure the date for your event or session. No date is reserved until this retainer is received.
Final Payment: The remaining balance must be paid in full [X] days prior to the event or session date.
Currency: All prices are in US Dollars (USD).
3. CANCELLATION AND RESCHEDULING
Cancellation by Client: If the Client cancels the service, the retainer will be forfeited as liquidated damages to cover the Photographer’s loss of business opportunity.
Rescheduling: Sessions may be rescheduled (subject to availability) with at least [X] days’ notice. In the event of inclement weather preventing an outdoor session, the Photographer reserves the right to reschedule at no additional cost.
Force Majeure: If the Photographer cannot perform this agreement due to a fire, casualty, strike, act of God, serious illness, or other cause beyond the control of the parties, the Photographer shall return all monies paid and shall have no further liability.
4. ARTISTIC LICENSE AND STYLE
Style Acknowledgment: The Client has reviewed Gabby Aguirre Photography’s portfolio and is familiar with the “Cinematic Moody Fine Art” style.
Artistic Discretion: The Client grants the Photographer full artistic discretion regarding poses, lighting, locations, and post-processing.
Editing: Images will be edited according to the Photographer’s artistic vision (moody tones, cinematic contrast). RAW (unedited) files are not available for purchase and will not be released under any circumstances.
5. COPYRIGHT AND USAGE RIGHTS
Copyright: Gabby Aguirre Photography retains the copyright to all images created, in accordance with United States Copyright Laws.
Client Usage: The Client is granted a personal print release for personal use and social media sharing. The Client may not sell, publish for profit, or alter the images (including applying filters like Instagram/TikTok filters) without written permission.
Model Release: The Client grants Gabby Aguirre Photography the right to use the images for marketing, portfolio, website, and social media purposes.
6. EVENT GUIDELINES (WEDDINGS & QUINCEAÑERAS)
Meals: For event coverage lasting longer than [5] hours, the Client agrees to provide a hot meal for the Photographer (and assistant, if applicable) during the reception.
Exclusivity: Gabby Aguirre Photography shall be the sole professional photographer hired for the event unless otherwise agreed upon in writing.
7. LIMITATION OF LIABILITY
In the unlikely event of a technical failure, loss of data, equipment theft, or any other circumstance that prevents the delivery of images, liability is limited to the return of all payments received. The Photographer is not liable for indirect or consequential damages.
8. JURISDICTION
This agreement shall be governed by and construed in accordance with the laws of the State of Indiana.
